2. CONTRACT OF SALE & PRICING

2.1 Order Acceptance:

Your order on this website constitutes an offer to buy the Goods. A legally binding contract is only formed when we formally dispatch your items and send you a shipping confirmation email.

We reserve the right to decline or cancel any order prior to dispatch due to stock shortages, pricing errors, or inability to authorize payment.

2.2 Retaining Legal Title:

When you purchase a physical painting, book, or print, you are buying the physical object only.

**Ownership of the underlying copyright remains entirely with Viki Collins.

** You do not acquire the right to reproduce, print copies of, or commercially exploit the artwork or text contained within the items you buy.

2.3 Risk:

Risk of loss or damage to the physical Goods passes to you upon delivery.

Full legal title to the physical items only passes to you once we receive cleared payment in full.

3. STATUTORY RIGHT TO CANCEL (CHANGE OF MIND)

3.1 14-Day Cooling-Off Period:

In accordance with the *Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013*, you have the right to cancel your purchase of standard books and pre-made art prints for any reason within **14 days** from the day after you (or a designated third party) take physical possession of the Goods.

3.2 Exclusions for Custom Work:

This statutory right to cancel does **not** apply to custom artwork, personalized commissions, or items made to your specific measurements or requirements. All sales of commissioned or customized artwork are final.

3.3 How to Cancel:

To exercise your right to cancel, you must notify us via a clear, written statement sent to: viki@vikicollins.co.uk before the 14-day cancellation period expires.

 

3.4 Returning the Goods:

Once you have notified us of your cancellation, you must safely package and return the Goods to the address we will provide to you, within **14 days** of that notification.

 

3.5 Cost of Return Shipping:

- You must bear the direct cost of returning the Goods to us if you have changed your mind.

- You are responsible for ensuring the items are returned undamaged.

We strongly recommend using a tracked, insured postal service.

We reserve the right to deduct an amount from your refund if the value of the goods has been diminished due to unnecessary handling or inadequate return packaging.

3.6 Refund Processing:

We will issue your refund within **14 days** of receiving the returned Goods (or receiving valid proof that they were sent back). We will refund the purchase price plus our **standard outward delivery cost**.

If you chose an expedited or premium shipping method at checkout, we will only refund the equivalent cost of our cheapest baseline shipping tier.

4. FAULTY, DAMAGED, OR MISDESCRIBED GOODS

4.1 Your Consumer Rights:

Under the *Consumer Rights Act 2015*, all physical Goods supplied by us must be of satisfactory quality, fit for purpose, and match the descriptions provided on this website.

4.2 Short-Term Right to Reject (Within 30 Days):

If your book or artwork arrives damaged in transit, is faulty, or is significantly misdescribed, you have a statutory right to reject the goods and receive a full refund within **30 days** of delivery. You must contact us within this timeframe and provide photographic proof of any damage.

4.3 Remedies After 30 Days:

If a structural fault or defect appears after 30 days but within 6 months of delivery, you are entitled to a repair or replacement. If a repair or replacement is not possible or fails to resolve the issue, you are then entitled to a full or partial refund.

4.4 Return Shipping for Faulty Items:

Where Goods are proven to be faulty, damaged, or misdescribed upon arrival, **we will cover the cost of the return postage** or provide you with a pre-paid shipping label.

5. Sales of Digital Downloads, Cancellations, and Refunds

 

5.1. Delivery of Digital Content

• Digital items become available for download immediately after your payment goes through.

• We send a confirmation email with a link to access your files.

• Contact us via support if you experience any technical trouble downloading your files.

• DIGITAL DOWNLOADS DO NOT INCLUDE A PHYSICAL PURCHASE, UNLESS YOU HAVE PURCHASED A PHYSICAL PRODUCT SEPARATELY.​

 

5.2. Loss of Cancellation Rights (Waiver)

• Under UK law, you normally have 14 days to change your mind and cancel an online purchase.

• However, by clicking "Download Now" or completing your purchase, you explicitly consent to immediate delivery.

• You acknowledge that this immediate access waives your 14-day right to cancel or claim a change-of-mind refund once the download starts.

5.3. Faulty or Defective Digital Content

• Under the Consumer Rights Act 2015, all digital downloads must be of satisfactory quality, fit for purpose, and as described.

• If your downloaded file is corrupt, missing, or broken, we will provide a repair or a replacement working file within a reasonable time.

• If we cannot fix the fault or replace the file without significant inconvenience, you may receive a partial or full refund.

• We are not liable for faults caused by your failure to meet minimum system requirements or if your device lacks proper security updates.
